* There is no entry fee
* The contest is open submission
* Professional and amateur photographers may submit
* Entrants grant Kern's Kitchen, Inc. a unlimited full license and rights
to use the images in any promotional materials
* Entrants agree to allow Kern's Kitchen, Inc. to publish submitted
images in any print or electronic form without compensation
* If the subject of a photograph is a minor (under the age of 18),
the entrant must have a written release from the parent or legal
guardian of the minor
* Entrants must own all rights to any images submitted
* Contact information must be provided for each individual image
submitted
* All decisions are made at the sole discretion of Kern's Kitchen,
Inc. and are final
* Photo
submission guidelines
* Photos must
include a DERBY-PIE® box or pie
* Only digital photos will be accepted (.jpg format)
* Entrants should use largest file size setting on camera and highest quality setting
* Entrants may enter as many images as they want
* The decision to use a photo or deem it appropriate is at the sole
discretion of Kern's Kitchen, Inc.
* By submitting an image, the entrant represents and warrants that
such submission does not infringe any third party rights or other
rights protected by law

of an image to the contest automatically constitutes the entrants
acceptance of all conditions set forth in the above rules
* Entries not complying with these rules will be disqualified
* Limitation of Liability: BY PARTICIPATING IN THE PHOTO CONTEST,
YOU WAIVE ANY RIGHT TO CLAIM AMBIGUITY IN THE RULES, AND RELEASE,
INDEMNIFY AND HOLD HARMLESS KERN'S KITCHEN, INC., THEIR ADVERTISING
AND PUBLIC RELATIONS AGENCIES, AND ALL OF THEIR RESPECTIVE AGENTS,
REPRESENTATIVES, OFFICERS, DIRECTORS, SHAREHOLDERS AND EMPLOYEES
(COLLECTIVELY, 'RELEASEES'), FROM AND AGAINST ANY INJURIES, LOSSES,
DAMAGES, CLAIMS, ACTIONS, OR ANY LIABILITY OF ANY KIND RESULTING
FROM OR ARISING FROM PARTICIPATION IN THE PHOTO CONTEST (INCLUDING
BUT NOT LIMITED TO ANY USE, MISUSE, OR NONUSE OF THE PRIZE BY THE
WINNER), OR ACCEPTANCE, POSSESSION, USE, MISUSE OR NONUSE OF THE
PRIZE THAT MAY BE AWARDED. WINNERS AGREE TO ACCEPT THE PRIZES 'AS
IS'. WINNERS ASSUME ALL LIABILITY FOR ANY INJURY OR DAMAGE CAUSED,
OR CLAIMED TO BE CAUSED, BY PARTICIPATION IN THIS PROMOTION OR USE
OR REDEMPTION OF ANY PRIZE.
* Additional Terms and Conditions: By participating in this promotion,
you agree to be bound by the Official Rules, the contest terms and
any and all the decisions of the judges which are final. Kern's
Kitchen, Inc. reserves the right to change these rules or cancel
the photo contest at any time, at its sole discretion. In the event
there is a discrepancy or inconsistency between disclosures or other
statements contained in any contest materials and the terms and
conditions of the Official Rules, the Official Rules shall prevail,
govern and control. All disputes relating to the photo contest shall
be governed by the laws of the Commonwealth of Kentucky. Kern's
Kitchen, Inc. and their advertising and public relations agencies
are not responsible for printing or typographical errors in any
photo contest related materials; or for transactions that are lost,
misdirected, fail to enter into the processing system, or are processed,
reported, or transmitted late or incorrectly, or are lost for any
reason including computer, telephone, paper transfer, mail system,
human or other error; or for electronic, computer, or telephonic
malfunction or error, including inability to access any web site
associated with this photo contest, or process any transaction thereon.
You acknowledge and agree that the photo contest is one of skill,
not chance. You further acknowledge and agree that your ability
to succeed in the photo contest will be based purely on your skill
versus that of other participants. The photo contest is void where
prohibited or restricted by law, and is subject to all applicable
mandatory federal (national), state and local laws. Entrants are
solely responsible for assuring that no legal claims are brought
against Kern's Kitchen, Inc. and their advertising and public relations
agencies regarding the content of their submitted image or the subjects
in their submitted image. If any third party claims are brought
against Kern's Kitchen, Inc. or their advertising and public relations
agencies, the entrants hereby acknowledge and agree to indemnify
Kern's Kitchen, Inc. and their advertising and public relations
agencies.
